Agosto\/2024.-<\/p>\n<p>Como medio especializado en seguridad social, <strong>\"Sociedad y Seguridad Social\"<\/strong> expresa su preocupaci\u00f3n sobre la reciente intenci\u00f3n del presidente Luis Abinader de proponer a Miguel Ceara Hatton para el cargo de Superintendente de Salud y Riesgos Laborales (SISALRIL). Es crucial recordar que, seg\u00fan la Ley No. 87-01 que rige el Sistema Dominicano de Seguridad Social (SDSS), no es facultad del Presidente de la Rep\u00fablica proponer candidatos para este cargo.<\/p>\n<p><strong>Los Art\u00edculos 22 , literal e) y el 177<\/strong> de la Ley No. 87-01 establece claramente que la designaci\u00f3n del Superintendente de la SISALRIL debe realizarse a partir de una terna presentada por el Consejo Nacional de Seguridad Social (CNSS). Esto significa que el CNSS, no el Presidente, es el \u00f3rgano encargado de proponer los candidatos. La funci\u00f3n del Presidente se limita a escoger y designar a uno de los tres candidatos preseleccionados por el CNSS.<\/p>\n<p>Cabe destacar que el presidente Luis Abinader ha demostrado en m\u00faltiples ocasiones su firme compromiso con el respeto a la ley y la institucionalidad. A lo largo de su mandato, ha actuado en estricto apego a las normativas vigentes, garantizando la transparencia y la legalidad en los procesos de designaci\u00f3n de funcionarios p\u00fablicos. Es por ello que resulta esencial que este proceso se mantenga dentro de los l\u00edmites legales establecidos.<\/p>\n<p>Cualquier intento del Presidente de influir en la conformaci\u00f3n de la terna, proponiendo nombres para ser incluidos, constituir\u00eda una violaci\u00f3n de las bases legales establecidas. Este proceso est\u00e1 dise\u00f1ado para garantizar la transparencia, la representatividad y la independencia en la selecci\u00f3n de los principales funcionarios del sistema de seguridad social.<\/p>\n<p>Es fundamental que el Presidente contin\u00fae respetando los l\u00edmites de sus facultades y permita que el CNSS cumpla con su rol de manera aut\u00f3noma, asegurando que el proceso de selecci\u00f3n se lleve a cabo conforme a la ley.
